TD Insurance

TD Insurance, part of the TD Bank Group is the largest direct response home and auto insurer in Canada. They are one of Canada’s largest financial organizations. They provide home, car, travel, life, critical illness and disability, and health insurance to individuals, and businesses throughout Canada. They are pioneers in affinity marketing, working with professional organizations to market their products. TD Insurance is a key player in the critical illness insurance market.

As a highly experienced personal injury and disability insurance lawyer, Rob Deutschmann and his well-trained legal team is dedicated to assisting those who have had their disability benefits wrongly denied by the disability insurer. His team has successfully protected the rights of injured people in Ontario for over 20 years, and has a proven track record recovering fair settlements.

Our client worked in a small machine shop as a machinist. Over time he developed severe back and neck pain. It eventually became too painful for him to work. The disability insurance policy provided for a change of definition after two years to any occupation based on his education, training and experience. The policy also provided that he would not be considered disabled if he was able to work at some employment that paid him at least 60% of his pre-disability income. The policy was also time limited for a 5 year period from the date of disability. That meant our client would have no access to any income under his disability policy after 5 years, even if he continued to be disabled. After two years, under the “own” occupation definition, the disability insurer decided that our client was capable of doing some other work and terminated his benefits. We were retained by our client and immediately started a law suit against the disability insurer. By maintaining litigation pressure, and obtaining some medical reports that outline our client’s ongoing difficulties and continuing inability to work, we were successful in assisting our client in obtaining a payout from the disability insurer for the balance of the term of the policy.
