Our client was a general labourer in a factory setting. Unfortunately, due to years of smoking and environment, she developed severe respiratory problems including chronic obstructive pulmonary disorder (COPD). We obtained medical reports from our client’s treating physicians to show that her work capacity was greatly reduced. In addition, our client had qualified for Canada Pension Plan Disability (CPP-D). We eventually met with the disability insurer at a settlement conference and we were able to obtain a solid settlement package for our client. As the benefits were taxable we were able to structure the settlement to allow our client to reduce the amount of tax payable by arranging to have the settlement funds allocated to several prior tax years, thereby lowering the rate of tax payable.
