Skateboarder in collision with car entitled to medical benefits from car insurer.

It was reported in the Waterloo Region Record that a skateboarder suffered serious injuries after the skateboarder collided with a pickup truck in the City of Cambridge.  The young male was skateboarding in the area of Glen Road and Brooklyne Road at around 10pm.  The skateboarder rolled into the side of a truck at the intersection.  The skateboarder was taken to Cambridge Hospital and then later transferred to Hamilton Hospital.  Whether you are a pedestrian, bicyclist or a skateboarder, and you are involved in an accident with a motor vehicle, like a car or truck, then you will be entitled to medical and rehabilitation benefits provided by a car insurer.  Where you do not have your own car insurance, the you will be entitled to statutory accident benefits from someone upon whom your are dependent, or from the operator of the vehicle involved in the accident.  Where the car or truck driver does not have valid car insurance, then there is the Motor Vehicle Accident Claims Fund that has been established by the Province of Ontario.  It is important to consult with a personal injury lawyer to assess whether the incident that resulted in the injuries might be considered an "accident" involving a motor vehicle and thereby entitle the victim to statutory accident benefits.  The accident benefits include medical and rehabilitation services, income replacement benefits and attendant care services.
