Pedestrian involved in car accident entitled to medical benefits

October 08, 2015, Kitchener, Ontario

Posted by: Robert Deutschmann, Personal Injury Lawyer

The Waterloo Region Record reported on a serious accident that occurred involving a pedestrian and one or two cars.  The accident occurred on October 8, 2015, at Highland Road East and Heiman Street in Kitchener.  The police reported that one of two cars involved in the accident may have fled the scene.  The pedestrian was taken to hospital with serious injuries after the accident.

When a pedestrian is involved in an accident involving a car, the pedestrian will be able to access medical benefits from the pedestrian’s own policy of car insurance.  If the pedestrian does not own a car and does not have car insurance, then the medical benefits may be obtained from the insurance policy of a person that the pedestrian is dependent on.  If there is no such car insurance policy available then the injured pedestrian can obtain medical benefits through the car insurance for the driver that caused the accident.  If the car driver flees the scene, as in this case, and there is no information about any other car insurance policy, then the pedestrian will be entitled to make a claim against the Motor Vehicle Accident Claim fund.
