There is no such category in law as the ordinary rural driver that does not stop at stop signs.

A recent Court of Appeal decision overturned a ruling that created a new category of driver, " the ordinary rural driver that does not stop at stop signs".

The case involved a newly licenced 16 year old G2 driver who ran through a rural stop sign at 80 km/h subsequently hitting a bridge abutment and suffering devastating injury. The driver sued the municipality for not providing adequate signage warning of a curve in the road and the upcoming bridge. Evidence showed that had the young driver stopped at the stop sign, his rate of speed would have been controlled and he would not have hit the bridge.

The appellant court ruled that the creation of a new category of driver 'rural who does not stop at stop signs' was incorrect and that the municipality met its standard of care.
