Recent case in Nova Scotia sees province sue disabled person to recover cost of care

The CBC recently reported on Ms. Hunter's case in Nova Scotia. After being catastrophically injured at the age of 15 the now 33 year old has left her catastrophically injured. Severely brain injured, she has spent the last 18 years unable to walk or talk and being tube fed.

Her case has at long last been settled and she received a $1.5 M reward from the driver and a dog owner involved in the case. Upon learning of the settlement the province launched its legal action to recover some costs of care in the hospital. The province has defended its position. The family for its part has been using the funds to pay the many costs of care that are not provincially funded such as physiotherapy and additional nursing care. A ruling in the case is expected in early January 2015.

An experienced personal injury lawyer can calculate what the dollar figure of any subrogation may be and will ensure costs for appropriate care and treatment are included in any damage claims made. The Ministry of Health in Ontario has a publication to help guide health care providers in their billing.

If you are injured in an accident caused by someone else's negligence I can help guide you to a fair settlement.
