COVID-19 UPDATE

Municipalities may face further blame for car accidents.

June 25, 2015, Kitchener, Ontario

A recent court decision holding a municipality responsible for crop damage on a farmer's field due to road salting, and one which held a municipality accountable for catastrophic injuries due to poor guard rail design highlight some of the problems faced in managing their liability for car accidents.

Many car accidents are caused by negligence, but road conditions (ice, deteriorations etc.), along with poor design or signage are causing a good number of them as well. Municipal and provincial governments are now having to balance costs of maintenance and construction, with the cost of liability not only to drivers but neighbouring landowners.

This balancing act will be an interesting process to watch, however ultimately we will all pay for it through our premiums and our taxes.
