Is the car insurance business broken?

The Insurance Bureau of Canada and the Ontario Trial Lawyers Association have been public about their dislike of one another's business practices lately. The IBC claims that the OTLA needs more oversight and regulation claiming that lawyers and their contingency fees are pushing the price of insurance up. They claim lawyer fees are simply too high.

The Lawyers, however, maintain that it is the Insurance companies have been overcharging customers for years, and have been denying valid claims and causing unreasonable hardships for consumers in the process. The OTLA has called for an immediate and thorough investigation by the Ontario Auditor General of insurance companies.

The IBC claims that lawyers’ fees are real dollars that never reach the injured party. The IBC forgets to state though that they pay a portion of the lawyers’ fees. The IBC also forgot to disclose how much money is lost in the settlement process paying for so-called independent medical examinations which are used to deny or reduce benefits to claimants.

Add onto this the government’s continuing pledge to reduce premiums at the cost of the injured parties and we have a fine mess indeed.

Ultimately it is the injured parties who are losing out on badly needed benefits for which they think they paid.
