Car accident benefits are not paid automatically following an accident.

Anytime that you are injured in a car accident, whether you are in the car, or you are a pedestrian or cyclist, you must follow a concise series of steps in order to get accident benefits from the insurance company. Here is a very brief list of the steps.

  1. Driver, passenger, and pedestrians/cyclists, injured in a car accident must notify their car insurer within 7 days of an accident.
  2. The insurance company will then promptly give the injured person accident benefit application form. If you are a passenger in the car you must inform your own car insurance company as well. These forms must be completed and filed with the insurer within 30 days of receipt. The forms are not difficult to complete but if you have any questions you should consult a lawyer for assistance.
  3. You must consent to the disclosure of medical information to the car insurer. It is important to cooperate with the insurance company.

Once the insurance company has your information they are required to review it and to advise you of their decision in a timely manner. The amount of benefit paid will depend upon the severity of the injuries.
