Bicycle rider hit by unidentified truck driver can still access medical benefits and bring claim for damages.

Ontario Provincial Police are searching for a truck driver after a hit-and-run collision involving a cyclist and a transport truck or a straight truck.  The truck bicycle acccident left a cyclist badly injured in a ditch between Kincardine and Ripley on June 26.  The cyclist was taken to the local trauma hospital by helicopter.  Even if the truck is not found, the cyclist will still have access to accident benefits and even a claim for damages if the accident was caused by negligence on the part of the truck driver.  The bicycle rider will be able to access his or her own car insurance for coverage.  All car insurance policies carry coverage to protect you in the event that you are injuried in an accident by an unidentified driver or even where the at fault party is carrying insufficient liablity coverage, or liability coverage that is less than your own policy.  In the event that you do not have a policy of your own, you would be covered if you were a dependant, such as a child hurt in a hit and run accident would be covered by a parent's car insurance policy.  If still no available car insurance policy, then you will be able to access coverage from the Motor Vehicle Accident Claims Fund operated by the province.  The Motor Vehicle Accident Claims Fund is considered a payer of last resort.  The Fund will provide accident benefits, including medical and rehabilition benefits, and provide you with an opportunity to bring a claim for damages sustained in an accident.  So even if the car, truck or other vehicle is not identified, you should still consult with a personal injury lawyer to find out what options you have for medical benefits and damages.
