Our client was a general labourer in a factory setting. Unfortunately, due to years of smoking and environment, she developed severe respiratory problems including chronic obstructive pulmonary disorder (COPD). The disability insurer paid our client disability benefits for a three year period but then terminated the benefits when the adjuster believed that our client was capable of some work. Given that our client was a general labourer the disability adjuster felt that there were many options for other occupations. However, our client lacked the stamina and ability to work at any part-time or full-time position. We obtained medical reports from our client’s treating physicians to show that her work capacity was greatly reduced. In addition, our client had qualified for Canada Pension Plan Disability (CPP-D). We eventually met with the disability insurer at a settlement conference and we were able to obtain a solid settlement package for our client. As the benefits were taxable we were able to structure the settlement to allow our client to reduce the amount of tax payable by arranging to have the settlement funds allocated to several prior tax years, thereby lowering the rate of tax payable.
