Injured Person must take Steps to Mitigate Losses
Injured person needs to be able to show that reasonable steps were taken to attempt to minimize or mitigate losses suffered in the accident. Where it cannot be shown that the injured person acted reasonably, then the trial judge could reduce the amount of damages awarded to the injured person. This includes following up on treatment recommendations to recover from injuries as soon as reasonably possible.
